These Terms & Conditions apply to your use of the Bella Boo Ireland website and to purchases made through our online store at www.bellabooireland.com.

Please read these Terms & Conditions carefully before using our website or placing an order.

Nothing in these Terms & Conditions is intended to exclude, restrict or limit any statutory consumer rights that apply to you under Irish or applicable European Union law.

2. Products

Bella Boo Ireland sells nail products, hair products, nail tools and accessories, and certain electrical equipment intended for nail use.

We make reasonable efforts to ensure that product descriptions, photographs, colours, specifications and other information displayed on our website are accurate and up to date.

However, colours shown on a computer, tablet or mobile device may vary slightly from the actual product depending on the device and display settings.

All products are subject to availability.

We reserve the right to update product information, specifications or availability where reasonably necessary.

Any changes made after you have placed an order will not affect an order that has already been accepted, except where permitted or required by law.

3. Product Use and Safety

Products must be used only for their intended purpose and in accordance with any instructions, warnings and safety information supplied with the product.

For electrical equipment, you should read and follow the manufacturer's instructions and safety information before use.

You should not modify, dismantle or attempt to repair electrical equipment unless this is expressly permitted by the manufacturer.

Customers are responsible for ensuring that products are used safely and appropriately.

Nothing in these Terms & Conditions limits your statutory rights in relation to products that are faulty, defective, unsafe or otherwise do not conform to the contract.

4. Product Availability

We make reasonable efforts to ensure that stock information displayed on our website is accurate.

If a product becomes unavailable after you place an order, we will contact you where reasonably possible.

Where we cannot supply a product you have paid for, we will provide an appropriate refund or other remedy in accordance with applicable law.

5. Placing an Order

When you place an order through our website, you are making an offer to purchase the products selected by you.

Before completing your purchase, you will have the opportunity to review your order and correct any errors.

You should check your order carefully before submitting it.

When you submit an order, you agree to pay the applicable product price, delivery charges and any other charges clearly displayed at checkout.

6. Order Confirmation and Acceptance

After placing an order, you will normally receive an order confirmation by email.

The order confirmation confirms that we have received your order but does not necessarily mean that your order has been accepted.

We may refuse or cancel an order where, for example:

  • A product is unavailable;

  • There is an obvious pricing or product-information error;

  • We reasonably suspect fraudulent or unlawful activity;

  • We are unable to fulfil the order; or

  • There has been a material breach of these Terms & Conditions.

If we cancel an order after payment has been taken, we will refund the relevant amount paid.

We will not use this provision to unfairly cancel a contract or avoid our obligations under applicable consumer law.

7. Pricing

All prices displayed on our website are in Euro (€).

Prices include VAT where applicable.

Any applicable delivery charges or other mandatory charges will be displayed before you complete your purchase.

We reserve the right to change prices at any time. Price changes will not affect an order that has already been accepted, except where there has been an obvious error or where otherwise permitted by law.

8. Payment

We accept the payment methods displayed on our website at the time of purchase.

Payment must be successfully authorised before an order can be processed.

You must provide accurate billing and payment information.

Payments may be processed through third-party payment providers. Your use of those payment services may also be subject to the provider's own terms and policies.

9. Delivery

We use DPD as our delivery service provider. While we make reasonable efforts to ensure orders are delivered within the estimated delivery timeframe, we cannot be held responsible for delays caused by circumstances outside our reasonable control, including courier delays, severe weather, transport disruption, strikes, customs issues, road closures, or other unforeseen events.

Where a delay occurs, we will make reasonable efforts to assist you and, where appropriate, contact DPD to investigate the delay.

Any delivery timeframe provided is an estimate and is not a guaranteed delivery date unless expressly stated otherwise.

Nothing in this section limits your statutory consumer rights relating to delayed delivery or non-delivery.

10. Risk in the Goods

Where you are a consumer, responsibility for the goods generally passes to you when you, or a person nominated by you other than the carrier, physically takes possession of the goods.

We remain responsible for the goods until that point, subject to applicable law.

11. Returns, Cancellations and Refunds

We want you to be happy with your purchase. However, due to the nature of some of our nail, beauty, cosmetic and personal-use products, certain products may be subject to legal hygiene exceptions.

Change of Mind

For online purchases, consumers generally have a statutory 14-day cooling-off period under Irish consumer law. If you wish to cancel an eligible online order because you have changed your mind, you must notify us within 14 days from the day you receive the goods.

After notifying us of your cancellation, you generally have a further 14 days to return the goods to us.

Unless otherwise required by law:

  • You are responsible for the direct cost of returning the goods to us when cancelling because you have changed your mind.

  • You are responsible for ensuring that the returned goods are packaged appropriately and safely.

  • We may reduce the refund where the value of the goods has been diminished by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

  • Where applicable, we will refund the standard delivery charge originally paid for the order.

  • We are not required to refund any additional amount paid for a more expensive delivery option where you chose a delivery method other than our standard delivery service.

The above does not apply where the goods are faulty, defective, damaged, incorrectly supplied or otherwise do not conform to the contract.

Products We Cannot Accept for Return

For health and hygiene reasons, the statutory right to cancel may not apply to certain products once they have been unsealed after delivery.

Depending on the nature of the product, this may include:

  • Cosmetics;

  • Nail products;

  • Beauty products;

  • Skincare products;

  • Personal-use beauty accessories;

  • Opened or used beauty tools;

  • Certain products supplied sealed for health or hygiene reasons where the seal has been removed.

This hygiene exception applies only where permitted by applicable law. It does not remove or restrict your rights where a product is faulty, defective, damaged, incorrectly supplied or otherwise does not conform to the contract.

Wrong Item, Wrong Shade, Colour or Variation

Please check your order carefully before completing your purchase.

If you have selected the wrong product, shade, colour, size or variation, this may be treated as a change-of-mind return where the statutory right to cancel applies.

If you have received a product that is different from the product you ordered, please contact us and we will deal with the matter as an incorrectly supplied product.

Order Cancellations Before Dispatch

If you wish to cancel an order before it has been dispatched, please contact us as soon as possible.

We will make reasonable efforts to accommodate cancellation requests received before dispatch. However, because orders may enter processing quickly, we cannot guarantee that a cancellation request can be completed before dispatch.

If the order has already been dispatched, the statutory cancellation and return rules described in these Terms & Conditions will apply.

Nothing in this section removes or restricts any statutory consumer cancellation rights.

12. Faulty, Damaged, Defective or Incorrect Products

If your order arrives:

  • Damaged during transit;

  • Faulty;

  • Defective;

  • Not as described;

  • Not fit for its intended purpose; or

  • Different from the product you ordered,

please contact us as soon as possible.

We ask that you contact us within 48 hours of delivery where possible, particularly for products damaged during transit, so that we can investigate the issue promptly.

However, failure to contact us within 48 hours does not remove or restrict any statutory consumer rights you may have under Irish law.

To help us resolve the issue quickly, we may ask you to provide:

  • Your order number;

  • Clear photographs of the product;

  • Clear photographs of the packaging;

  • A description of the issue; and

  • Where appropriate, photographs or video demonstrating a fault.

Where a product is faulty, defective, damaged, incorrectly supplied or otherwise does not conform to the contract, your statutory consumer rights apply.

Depending on the circumstances and applicable law, you may be entitled to:

  • A refund;

  • A replacement;

  • A repair;

  • A price reduction; or

  • Another appropriate statutory remedy.

If you exercise a statutory remedy because goods are faulty or otherwise do not conform to the contract, we will cover the applicable reasonable return costs or reimburse you for those costs where you have paid them upfront, as required by law.

For a qualifying fault reported within 30 days of receiving the goods, Irish consumer law provides a short-term right to terminate the contract and obtain a refund, subject to the applicable legal requirements.

We are not responsible for damage caused by misuse, accidental damage, improper installation, failure to follow manufacturer instructions, unauthorised modification, normal wear and tear, or use of a product for a purpose for which it was not intended.

Change-of-Mind Returns

Where you are exercising your statutory 14-day cancellation right:

  1. You must notify us within the applicable 14-day cooling-off period.

  2. You must return the goods within the applicable return period.

  3. You are responsible for the direct cost of returning the goods.

  4. The goods should be returned in an appropriate condition, subject to the statutory rules concerning reasonable handling.

  5. Where applicable, we will refund the standard delivery charge originally paid.

We recommend using a tracked delivery service when returning goods, as you are responsible for the goods until they reach us.

Faulty, Damaged or Incorrect Goods

Where goods are faulty, defective, damaged, incorrectly supplied or otherwise do not conform to the contract, the return costs will be handled in accordance with your statutory consumer rights.

We will not require you to bear the return cost where the law requires us to cover it.

Refunds

Where a refund is due, we will process it in accordance with applicable Irish consumer law.

Refunds will normally be made using the original payment method unless otherwise agreed or permitted by law.

Nothing in this Returns and Refunds section is intended to exclude, restrict or limit any statutory consumer rights available to you.

14. Electrical Products

Certain products sold by Bella Boo Ireland are electrical nail products or equipment.

Electrical products should be used in accordance with the manufacturer's instructions and safety information.

Where applicable, customers should ensure that the product is suitable for the intended use and electrical supply before use.

If an electrical product develops a fault, please stop using it and contact us.

Nothing in this section limits your statutory consumer rights relating to faulty, defective or unsafe electrical products.

15. Promotions and Discount Codes

From time to time, we may offer promotional prices, discounts or discount codes.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash;

  • Discount codes cannot be combined with other discount codes;

  • Discount codes may have expiry dates or product exclusions;

  • Promotional offers are subject to availability; and

  • Discount codes cannot normally be applied retrospectively to completed orders.

We reserve the right to withdraw or amend a promotion where there is a legitimate reason to do so, including where an offer has been published incorrectly.

Promotions do not affect your statutory consumer rights.

16. Website Use

You may use our website for lawful purposes only.

You must not:

  • Use the website for fraudulent or unlawful purposes;

  • Attempt to gain unauthorised access to our website or systems;

  • Introduce viruses, malware or other harmful code;

21. Events Outside Our Reasonable Control

We will not be responsible for delays or failures caused by circumstances outside our reasonable control, such as severe weather, natural disasters, fire, flood, industrial disputes, government action, major transport disruption or significant telecommunications or internet failures.

Where such circumstances affect your order, we will make reasonable efforts to minimise the impact and keep you informed.

This section does not affect your statutory consumer rights.

22. Changes to These Terms & Conditions

We may update these Terms & Conditions from time to time to reflect changes to our business, website, products or applicable legal requirements.

The Terms applicable to your purchase will generally be the version in effect when your contract is formed.

The latest version will be published on our website.

23. Complaints

If you have a complaint about a product, order or our service, please contact us first so that we have an opportunity to resolve the issue.

Please provide your order number and details of the issue where possible.

We will consider your complaint fairly and respond within a reasonable timeframe.

24. Governing Law

These Terms & Conditions are governed by the laws of Ireland.

If you are a consumer living in another EU Member State, nothing in these Terms is intended to remove or restrict any mandatory consumer protection rights available to you under applicable law.

Any dispute will be subject to the jurisdiction of the appropriate courts under applicable law.

25. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be modified or removed to the minimum extent necessary, and the remaining provisions will continue to apply.
